  1. A city can not pass a city ordnance against carry within that city. Of course any city can post city property per 39-17-1359
  2. If the law goes into effect July 1, then you could still be charged on June 30....whether an officer would or not...well who knows...I'm sure within in the whole state there are at least a handful that would, but OS has a good point as well.
  3. According to the letter I got from State of Washington AG when I asked him the same thing, it is because TN does not have a statutorily required mental health history check. Yes there is are certain mental health requirements in TN code, but there is not mental history check done by the state...and apparently WA requires that to honor other state's permits. As far as getting a Utah permit, the short answer is, Yes, for the most part. Some states only honor a permit from the state you are a resident of, but from what I can find it does not appear WA is one of those states.
  4. ...and I really have no problem with anyone informing, if that is what they want to do. I also admit there is a slight chance it could result in a favorable outcome on the reason for the stop. It is only when someone says there will be dire consequences if you don't or worse yet feel a LEOs "unfavorable" reaction is justified if you don't is when I tend to disagree.
  5. All I can say is, I have been on school grounds many times with my handgun in my car, most times I didn't put in the glovebox till I was already parked. Always made sure no one saw me and never had my car searched or asked to be searched or any other incidents. I personally never felt I was doing anything illegal, however that was based on my interpretation of the law and what I would tell a LEO and or judge. Others may not feel that way or want to take the same actions, and I am by no means recommending my actions to others.
  6. No...never have drawn my weapon....once or twice I have reached into my pocket and grabbed the grip, but that is about it. To go along with others...my dad always told me you don't draw a gun to scare someone, you draw it to shoot it. As far as a carry by someone <21 in TN...I believe they can as long as they have a valid permit from another state and are not a resident of TN. If they are a resident of TN, they would have to get a TN permit, which they can't get till they are 21. As far as sales to those <21 seems like that has been worked out already.

  8. Well a sign like that woldn't seem to comply with 39-17-1359 then as far as being posted in prominent locations, including all entrances primarily used by persons entering the building or containg language substantially similar to 39-17-1359
  9. LMAO....had to read it a second time and then re-read the quoted part, but that is pretty good.
  10. IMO to distinguish who drove the vehicle to the school and the one that has the keys, to show who could unlock it and also drive it and is responsible for the vehicle and it's contents. In TN law operating does not necessarily mean in motion. Just like you can be charged with a DUI, which is "operating" a motor vehicle while intoxicated, even if the car is parked and are in the back seat asleep if you have the keys or the keys are in the ignition.
  11. As you or someone said....probably could ask 10 different officials and get at least 5-6 different answers. But I'm still not sure if you have it locked up in your car before you get to school grounds.....How is anyone going to know it is in your car?

  15. True...that is 39-17-1310(4) I (and many others it appears) disagree. It seems the second half of 39-17-1309©(1) does allow that. Two different situations, two different parts of the law.
  16. I believe the part your emphasized has to do with the weapon of the operator of the vehicle, and him/her not handling it..or allowing someone else to handle it. As opposed to weapons by others in the vehicle. Not really sure how it works, if you're not the operator of the vehicle, but leave your handgun locked in the car when you go inside....
  17. IANAL, but IMO if it is still in the passenger compartment, you are in still in cosrtuctive possession of it, even if not in actual possession. If it was unloaded in the trunk, that might be different.

  19. +1 ...of course that doesn't mean all school officals and/or LEOs know the law. Also remember...if you are just dropping off or picking up students without getting out of the car, you can leave it on your hip even. 39-17-1310(4)
