I had this happen the other night, the out come was good for the deer since she got up and ran off the road. But suppose you were involved or happened upon a scene where a deer had been hit by a vehicle. The deer is alive but badly hurt and suffering. Would you shoot the deer and put it out of its misery. Keep in mind it is making the death groan, and you pull her off to the side and away from the on lookers. Your shot is in a safe direction. It could also be a while uptil any kind of LEO's can get to the scene.

Might as well end it. No need for it to suffer. Just make sure to let everyone know you're going to shoot it so that no one freaks out when you whip out your gun and let one rip.

Call the local LEOs and tell them that I'm armed and willing to dispatch the poor critter if they're OK with it.

That way I don't get taken down in a felony stop later in the evening for discharging a firearm or the oh so popular man with a gun call out.

didn't TN LEO get into a fiasco about that this summer? something about the LEO not discharging his firearm shooting out of season? and the collection guys couldn't touch it until it was dead...

I hit a deer a couple years ago and when the Tenn Trooper got there he asked me if the deer was dead, I told him yes and he said good because he said if he had to shoot it he had to fill out a long report about discharging his duty weapon, he also said he was thinking about getting another weapon to keep in his car to dispatch any hit deer with to keep from filling out the report. I asked him if it was still alive if I could have finished it and he said yes, he prefered it that way again to save him the paperwork.

The rule for keeping or posessing road kill is you just have to notify a LEO that you hit the deer and tell him you are going to keep it and you don't even have to legally check it in like you do if you kill one while hunting. If you have the deer processed though I am sure it will still have to have a kill tag.

Having said all that I would do as dunndw said and call LE to let them know I was going to finish the deer and then make sure of your shot direction and placement and finish it off. I hate for them to have to suffer, even when I am hunting I try my best to make a clean quick kill shot.

this is what I would do...but I would be more thinking about the "hunting without a license" or "hunting out of season"

but if they told me to do it...bye bye Bambi!!

It is a shame our laws are turned against people who are doing what is right – the need to cross all T’s and dot all I’s can cause more damage and suffering just to keep an antigun person on his “righteous thrown” is a bit much
