Article VI, paragraph two of the U.S. Constitution states: "This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding." I believe this means that approved treaties become the law of the land, i.e., the United States.

A small advantage is that we'll have the local politicians on record for the next election.

Hopefully Morristown can be educated as well. - Tim http://www.knoxnews.com/news/2009/jul/15/gun-ban-in-parks-denied-in-dandridge/ DANDRIDGE - Retired police officer Ronnie Smith of Dandridge has a gun-carry permit and is a pistol-packing believer in the right to carry firearms. "Most of the time I'm awake I've got mine," said Smith during a Tuesday night Dandridge City Council meeting that included a resolution to prohibit hand guns in public parks in the Jefferson County town. Smith, 68, was pleased with City Council's 4-2 vote which nixed the resolution that would have prohibited any person authorized to carry a handgun from possessing a handgun while within a public park, natural area, historic park, nature trail, campground, forest, greenway or waterway that is owned or operated by the town of Dandridge. "Criminals don't go to the police station or Army base, they go to parks, nursing homes and schools," said Smith as he addressed the gathering of 20 people at the meeting. Dandridge is one of many cities in Tennessee that has been mulling a new state law that comes into effect Sept. 1 that will allow citizens with handgun permits to carry guns in public parks. The new law has a loophole that allows cities and counties to axe the provision and keep their parks free from guns - after adoption of a resolution by the legislative body. Tuesday's decision by City Council was of particular note because Dandridge was rocked by a 2006 shooting where three adults were killed in an ongoing dispute between two families at a city ballpark complex at Grace Schrader Park called the "Field of Dreams." The shooting took place as more than 50 spectators filed out of a youth baseball contest at the complex on U.S. Highway 25W-70. The shooting was not related to any developments during the game. The other municipal park in Dandridge affected by Tuesday's vote is the Point Resort and Marina. Smith, along with several members of City Council, deemed the resolution as unenforceable. "You'd have to have 100 officers down there to pat people down," said Smith. "It's unenforceable and something we don't need. You have an incident that happened three years ago infringing on my rights." Town Administrator James Hutchins said he doubted any law banning firearms in the park would deter criminals from carrying guns. "No law we make can make people obey the law," said Hutchins. Like Smith, Dandridge resident Sabrina Large has a gun-carry permit and believes she should be able to carry a handgun in the city's parks. Large, 32, said the Field of Dreams shooting was part of the reason she decided to obtain a gun-carry permit. "That, and how the world is today," said Large, who frequently attends games and events at Field of Dreams. "People who have carry permits ought to be able to carry guns for their own safety - that's what we got them for."

Heh. Be nice to know if Mr. Anonymous is from one the 36 states that already allow their citizens to carry where alcohol is served.

I believe the NRA Civil Rights Defense Fund, Civil Rights Defense Fund - Statement of Purpose would only become involved if an injuction was granted.

Today's Morristown Citizen Tribune reports that Danridge officials will meet Tuesday, 14 July 2009, at the regular monthly meeting and will discuss "opting out" of the park carry bill, i.e., not allow HCP's to carry in Danridge city parks. The article contains many erroneous comments from city officials like implying that the law allows anyone to carry in a park. Representative Frank Nicely, a sponsor and strong supporter of the bill said, "My intent is to allow any man or woman with a legal carry permit from the state of Tennessee to be able to carry their gun in a state park." Of course the issue at hand is being able to carry in local parks because the recently passed law now allows HCP's to carry in state parks. Sorry, the article does not state where or what time the town meeting will be held. You'll have to dig that out on your own.

Senator Steve Southerland's office has informed me that the Senator will be at this meeting and available to discuss the guns laws passed and discussed in this session of the Assembly.

BATFE checking gun owners in border states
Tim Nunan replied to tnoutdoors9's topic in 2A Legislation and Politics
Unless the BATFE is following up on a firearm found in a crime how did they know who had "...recently bought, and ... that are types of guns frequently recovered in Mexico."? Nothing in that NRA-ILA article stated the the gun owners were suspected of a crime or that their firearm was involved in a crime. This begs the question of why/how the BATFE legally had access to gun purchase records. -
As stated in another forum the liability issue is a strawman; it is about the money and not having the cover of state law to hid behind.

Feeling real gloomy about our future
Tim Nunan replied to Glenn's topic in 2A Legislation and Politics
As I understand the system once a constitutional convention is convened all of the Constitution is subject to being changed, e.g., removing/changing the 2nd Amendment. -
Feeling real gloomy about our future
Tim Nunan replied to Glenn's topic in 2A Legislation and Politics
The problem is that the swing to right doesn't last as long as the swing to the left and it doesn't swing as far to the right as it does to the left thus moving the "center" farther left. -
A good thing from the Restaurant carry lawsuit?
Tim Nunan replied to Fallguy's topic in 2A Legislation and Politics
I've always thought that the Tennessee Restaurant Association and the restaurant owners liked hiding behind the law rather than having to make the decision to allow legal carry or not. Having to make the decision as the law now requires means the customer can also decide whether or not to spend money there and this is the crux of their problem... it is all about money. -
A good thing from the Restaurant carry lawsuit?
Tim Nunan replied to Fallguy's topic in 2A Legislation and Politics
The "liability" issue has been brought up many times and the consensus seemed to be that the establishment couldn't be held accountable for an unpredicable/unexpected/etc. act. If that is so why would the establishment be liable by allowing HC permittees there? -

Now I understand GOA's comments. I didn't realize he first betrayed us by helping to kill the filibuster knowing his confirmation vote would be useless.

Since there is no way we can produce enough ethanol without adversely affecting our food supply to an even greater degree than it is currently doing one has to wonder why there is an import tax on the Brazilian ethanol of at least $.50 per gallon, virtually killing the import. Guess saving the planet doesn't override agricultural economics. The politicians keep stating we have to reduce our dependence on foreign oil so… DRILL HERE and DRILL NOW!
-
Of course one has to "forget" the higher cost of producing the ethanol. It can't be sent via the pipelines because of the high water content ergo must be trucked to be mixed with gasoline, hardly a "saving". The use of grains diverted to make ethanol have increased cost of food formerly made from those grains. Ethanol can never replace gasoline since the demand for fuel exceeds the acreage needed even if every piece of land were devoted to growing grain just for fuel (to include land not currently in use). Biodiesel is a much more efficient fuel but some of the same problems apply there as well.

http://www.nraila.org/Legislation/Read.aspx?ID=5007 Friday, June 26, 2009 As anticipated, Tennessee counties and municipalities have started to opt-out of the park carry law passed by the Tennessee General Assembly during the 2009 session. Please contact your local officials and respectfully ask them not to create a confusing patchwork of laws that will close off local parks to law-abiding permit holders, who simply wish to be able to protect themselves and their families. If you have any information on Tennessee counties and municipalities taking steps to opt-out of this important self-defense law, please contact the NRA-ILA's State and Local Affairs Division. Contact information is provided below.
