It's not just late at night.... I seem to have trouble all times of the day. What is funny....I can be having trouble getting on, but get an e-mail that someone has made a post to a thread I have subscribed to....so that person was obvisouly able to get on at a point that I couldn't.

I think there may be some behind the scenes work going on and this is the route the bill will have to take to make all look good and save face. But I do not know for sure.....

I believe that is correct. I don't think anything goes straight from the confrence committee to the Governor, but back to both houses for consideration.

Not to make the arrest, correct. Only if self-defense or defense-of-a-third person would apply. Also the situation you describe is why I would guess lots of people/companies that employ private security probably limit when they want them to actually make an arrest and/or may even limit their use of force to make the arrest. -

Just to add after reading a few more post.... Could a SG forcibly detain you if you didn't do anything wrong?... No, but, if he told you to leave (for whatever reason)...and you have not left, you have violated the law, you are trespassing. So...if he chooses to arrest you, Yes, he could physical force to detain you. I would guess whether he would do that is partially up to how much potential liability the company he works for wants to open themselves up to. -

They can not detain you unless they place you under citizens arrest. 40-7-109 If someone does place you under citizens arrest they law says the person making the arrest "may use force reasonably necessary to accomplish the arrest" 39-11-621 Now how many store managers are going to go as far as actually placing your under arrest..... not many would be my guess. How many security guards would.....well, probably a few at least. I assume your question is based on my story about Wal-Mart in Columbia....I'm not for sure, but I would guess they probably don't even confront the person until LE shows up. -

See post 51. For purposes of carry in restaurants that serve alcohol they defined age restricted as any place restricts admission to those 18 and up, not 21 and up. So yes, for smoking it is 21+ per 39-17-1802(2) but not for carry in restaurants that serve alcohol. Both definitions apply only to the parts of the law they say they do. -

I admit....all of this tech talk is over my head....funny thing is I'm considered the "techno-geek" at work...lol But this is a different ball of wax. N-E-WAY I JUST HOPE WHATEVER IS CAUSING THIS CAN BE STOPPED!!! It is getting very frustrating for me. In fact....David, if you want to take donations to increase the size of the reward....just let me know...I'll for sure throw in a few bucks!!!

You're right....if a place that allows smoking doesn't card people as they enter...they are technically breaking the law. 39-17-1804(1) You can see the defintion of "age-restricted" as it applies to smoking in 39-17-1802(2) Also if a place has a big "NO ONE UNDER 21 ALLOWED" sign...I admit I would not want to try to argue with the judge that since they didn't card, they are not technically an "age-restricted venue" -
3 months...good I should have mine back before I go to my nephew's graduation in NC in June. You can just go to the local DL station to renew. Can go within 6 months of the expiration date. Since you just got your HCP they should already have your citizenship status on file, so it should be just filling out the renewal form and giving them $50.

Very good point. Also trespassing is a misdemeanor. A LEO can not make a charge unless it occurs in his presence. Of course the owner or security guard can file the charge. But if they call the PD then you could end up with a notice not to return given in the presence of a LEO which would be pretty binding. (See below) My brother works for Columbia PD....when the Wal-Mart there wants to effectively ban someone from the premises (for whatever reason), they call the PD, make the statement to the person in front of the LEO that they are not to come back, take the persons picture and fill out a form on them. Now I think they have a pretty solid case for trespassing if someone returns. I wouldn't advise any course of action that could make HCP holders look bad or could have legal repercussions. But if a property owner tells you to leave and not come back armed.... and for some reason you do later, it is probably the property owner that would have to file the charges...if they wanted to take the time to do it. Some larger business probably would...mom and pop may not. Even then it would be your word against theirs unless they bring witnesses and so on. All of which is a lot of trouble to buy something that you could probably get elsewhere. I think it could be situations like this, that the "announce" part was removed from 39-17-1359 and actually posting is required. Even though with the above AG ruling...announce on an individual basis is still pretty much in effect. -

I think everyone is pretty much right.... For those that want to read it here is an AG opinion about being asked to leave. (Questions 5 & 6). If they tell you to leave, you must leave.* If they tell you to leave and never come backed armed, you can never go back with a weapon.* If they tell you to leave and never come back period, you can never go back period.* * Or risk being charged with trespassing. If they simply ask you to leave it in the car, they have not told you "To not come back armed".
