  2. True, but when you go to bike night somewhere and they sell beer inside and you carry it out to the parking lot, that is legal and you can carry in the parking lot. So the law doesn't automatically prohibit carry where alcohol is consumed. The fact that any one business in the mall can close off it's doors and for all practical purposes separate/isolate itself would make some sort of difference you'd think. Of course I truly hope in the coming months all of this debate is moot anyway...

  6. See AG Opinion 07-43 I think if each business is considered separate, then just because one sells alcohol doesn't make the whole mall off limits. However if we can't get restaurant carry passed, I would like to see a more specific AG ruling about places like malls, hotels, bowling alleys, etc... where alcohol is served in part of the building, but not the whole building.

  10. It is up to you as to whether to carry or not. But if it is not properly posted per law, the worst they can do is ask you to leave. Short of going up to a security guard and telling them you are armed, no one should know if it is properly concealed. I'm not sure about this place, but many places on our Off-Limits places are not properly posted per law, I think a person that puts a place on the list can denote if it properly posted or not, but they are on there because of either an improper posting has been seen or the person was informed by some other means. Some want to know if it is against a places policy even if it not properly posted.
  11. I used to leave in McDaniels district, although I never liked that he voted for Nafieh as speaker, he was also in favor any pro-carry, pro-gun legislation I talked to him about.

  13. I'm sort of split on this whole thing. As far as I know...his only crime is simply having the weapon without a permit. From what I can tell it is not against the law to have a handgun in a place that sells alcohol for onsite consumption in NY, if you have a permit. I can't find anything for sure about consuming alcohol, but as others have posted that is legal in several states. Mode of carry and location, while maybe stupid, weren't illegal. But....if this was any other Joe it wouldn't even be in the news and they'd be in jail, no questions asked. Simply put, he broke the law, whether you agree with the law or not. I'm sure he knew the law, knew his was breaking it, got caught and now should have to face the consequences. I think overall I'd rather support reforming the law, not his breaking of it.

  17. True... As I was reminded in another thread, anytime a human kills another human it is a "homicide". In a self-defense situation it is called a Justifiable Homicide. So by apparent homicide, maybe he meant it was apparent that the person was killed by another and not by himself or natural causes, etc...
  18. Going with majority I guess.... If it is determined to be a good shoot nothing about the weapon or ammo etc... should come up. If there are any questions about it, it could be an issue. I admit I have no first hand knowledge, but there are several ways a shoot can be determined to be good though, isn't there? I mean the DA could simply say so and decided not to file charges based on the police report or it could go to grand jury and a no bill be issued, or anything in between, right? So it is is more than just the DA deciding not to pursue charges, I guess it could come up during that process, but whether it would be an issue or not...who knows
  19. The only difference between postings requirments for government and non-government places is the one I mentioned above. All Government places are NOT automatically off-limits by law. See 39-17-1359
  20. Remember though government buildings that had a sign prior to July 1, 2000 "that is in substantial compliance" with 39-17-1359 can keep using the same sign. I admit I am one of the first to ignore an improper posting, but a state agency may actually be one of the places that would push the issue. Also molonlabetn don't forget to join the Motorcycle Enthusiast group.

  23. Yes this is old....it is from last session, it was defeated, it would have to be re-introduced in the new session in 2009, it is also has been posted several times in the last few weeks. The search function can be your friend. Thread closed.
