  2. +1 Remember, you still can't carry in D.C. and you have to get a permit simply to have a handgun in your house. In fact I would say this situation has a chance of making things even worse for all of us.

  4. If you could post the source of that, I would like to see it. I can't find anything in theT.C.A. at Michie's Legal Resource that exempts a butterfly knife. You can see 39-17-1307 which makes it illegal to carry firearms, knives and other weapons. Then in 39-17-1308 there is a lift of defenses to the above law. Nothing about a butterfly knife is mentioned in there. If you came upon a LEO that wasn't familiar with that type of knife, it may all depend on how you opened it. If you slowly opened it with two hands, he may not worry about it. If you opened it "Bruce Lee" style, then it may not go as well. I don't think it would be illegal if you needed it for a lawful activity 39-17-1308(a)(4) is a defense that says if the possession is "Incident to lawful hunting, trapping, fishing, camping, sport shooting or other lawful activity" it is legal.
  5. I think the way bars get around the smoking ban is because they limit entrance to those 21 and over, not really because they are a bar. You can see 39-17-1804 for the list of exempted places on the smoking ban.
  6. 39-17-1305 as it is now prevents carry where alcohol period is served not just liquor, but beer also. So even if restaurants must get 51% or more or revenue from food to sell liquor by the drink, that does nothing for keeping up with revenue for the hundreds of restaurants that serve beer only.<O:p</O:p <O:p</O:p I didn't say the extra cost of keeping up with how much of sales came from what, just that it was the argument the other side was using. <O:p</O:p <O:p</O:p You are 100% correct about there being no bars in TN, at least not legally defined. But that is the whole trouble. The are some that are inclined to allow us to carry in restaurants, but do not want us to carry in what is commonly know as bars, taverns, etc... But with no legal definition of what a bar or tavern is, they are not sure how to word it. If you simply changed to allow carry only in restaurants, that does nothing to address other places that serve alcohol, but that is still not their man purpose. <O:p</O:p

  8. Seems like I heard the main argument against a "51%" law by the Restarunts Association is that it would be extra accounting work for them.

The last bill that was advanced would have removed the restriction period, so yes, it would have allowed carry in a bar, nightclub or any place that served alcohol, even if that was the only purpose. My understanding is, that there is nothing in TN law that defines what a bar, tavern, nightclub, etc... is. I think that was something that was going to try and be worked out over the summer so as there could be a bill that would allow carry in a restaraunt while still restricting carry in bars and the like. Of course since this will be a new session starting in Jan, a new bill will have to be written and introduced from scratch.
  11. I believe a Balisong or "butterfly" knife would fall under 39-17-1301(14)( or at least could if the officer chose to. As far as schools 39-17-1309((1) It is an offense for any person to possess or carry, whether openly or concealed, with the intent to go armed, any firearm, explosive, explosive weapon, bowie knife, hawk bill knife, ice pick, dagger, slingshot, leaded cane, switchblade knife, blackjack, knuckles or any other weapon of like kind, not used solely for instructional or school-sanctioned ceremonial purposes, in any public or private school building or bus, on any public or private school campus, grounds, recreation area, athletic field or any other property owned, used or operated by any board of education, school, college or university board of trustees, regents or directors for the administration of any public or private educational institution.

  13. I think OS is right, as long as the blade is under 4" and it would not be considered a switchblade, it is legal to carry it. From 39-17-1301(14) Switchblade knife means any knife that has a blade which opens automatically by: (A) Hand pressure applied to a button or other device in the handle; or ( Operation of gravity or inertia

I've thought about this a bit more and I think it may go back to word(s) we discussed in another thread..."are served" So we are all on the same page, here is the part of text of the law we are discussing. There are basically 4 elements required to make it off-limits for carry. Within the confines of building (Outside is ok) Open to the public (Your home, private club, motel room are ok) Served (Not sold so that the club is still off-limits even on free beer night.) On premises consumption (Package and convenience stores legal) There is no doubt that the Opryland Hotel is a building and that certain areas like the lobby and other places are open to public. But does that mean you can consume alcohol anywhere in the building? Even if you can, do they serve alcohol anywhere in the building? If you can sit in the lobby and have someone serve you a beer I would say the lobby would be off-limits or any other place you could be served an alcoholic beverage. If their license only allows for sales/service within the bar area, IMO everywhere other than the bar area would be ok to carry. Just my that may not be worth If the law is not changed, I think this would be a good thing for the AG to clarify. If you go to a bowling alley where there is a bar and they only serve drinks in the bar, does that mean the whole bowling alley is off-limits or just the area where drinks are served?
  23. An in-room stocked bar would not be a problem, because your room is not "open to the public" which is part of the law.
