I think OhShoot is pretty close to right. If he got your carry weapon and didn't immediately turn and run and you had BUG or other weapon, you may be justified. If during a struggle for the weapon it went off and struck him, again you may be justified. If you were able to get total control of the weapon, shooting him because he tried probably would not be justified. The law says if you have a reasonable fear of imminent death or great bodily harm you are justified in using deadly force. So there is no real way to give a correct answer to a general situation, it would depend on specifics of each situation.

He may be referring to 39-17-1301(15) which says.. But I don't think that means you can't have a loaded magazine period. Also it would seem as long as a loaded magazine isn't in the "immediate vicinity" of the weapon you are ok, just like with ammo in general. However having a loaded magazine and simply having out of the weapon but close, would not seem to be considered "Unloaded" by the law.

I still think all that can, should get their HCP, but... I did wonder when the state changed the self-defense law to include your car as a place where it is assumed someone trying to break in is going to try to cause you great bodily harm or death, why it didn't extend the same rights you have in your home for firearms to your car.

I agree, however there are those that seem to defend LEOs at all cost as well. Thankfully I think most of us fall somewhere in the middle, maybe slightly predisposed to one way or the other. It seems it is almost like the Pro and Anti Glock stuff. There are staunch opinions on both sides and several in the middle. There is nothing wrong with difference of opinions. I am good friends with a few people that they and I have very different views on things. I hope most of us are like that here and can debate the issue and not attack each other...and also realize the difference. -

So many people are against HCP badges because they think the simple act of wearing a badge means you are trying to impersonate an officer. Now there is a situation where someone shows a badge in what appears to be an attempt to justify his actions to that point and/or threaten repercussion for further actions and now it is, "How do you know it is was an officer?" "Did you get a DNA sample?" etc... from everyone. From what I read of the story the largest part of the aggression done by the other driver was before he found out he was "Number 1." No where did I read that he was bragging about acting bad towards the police. While flipping the bird may not have been the brightest thing to do, it somewhat understandable as an immediate reaction to the situation and does not appear to be an attempt to escalate the situation. Escalating would have been trying to follow him for whatever reason and possibly more thing occurring. Seems the OP caught himself so to speak and backed of before doing that. I agree there are many times I have seen people stay in the fast lane slowing traffic when they didn't have to, but that does not seem to be the case here. Also I agree there is no 100% way to know that just because the other driver flashed a badge that it for sure meant they were a LEO, but it doesn't seem unreasonable to assume that from the set of circumstances, at the very least the other driver was trying to give the impression he was a LEO. -
I would agree...the key is to stay in total control of the purse while the firearm is in it.

Do you already know this will be an issue? I mean have the said they don't like guns, etc...? If not then as others have said....it is situation normal for you and they should never know. If they somehow find out, you just keep as situation normal and go from there depending on their reaction. If you do know it is an issue, it is up to you if you want to push it.

Thankfully I've never had this problem. As others have said, good concealment and there shouldn't be a problem. In some states you are supposed to notify the owner of a home you are armed before you enter, but TX does not appear to be one. ...and not sure about respect, but the law will always recognize the right of a homeowner to control who and what is allowed in his house over your or anyone's right to carry.

Check here to see a list. Just remind her not to sit her purse down and/or leave it unattended while her weapon is in it. There have been cases of women's purses being stolen while their gun was in it.
