  1. That's correct you are under no legal obligation to answer them or even give a correct answer. But as he said, you more than likely be asked to leave....and if you are told to leave, for whatever reason, then you must do so or you can be charged with trespassing.
  2. Yes during a declared emergency many restrictions may be placed upon the public but, 58-2-107(m) specifically addresses the possession, transfer, sale, transport, carrying, storage, display or use of firearms during a civil emergency, major disaster or natural disaster.

  4. Welcome There are basically 5 places that are off limits to carry in TN. 1. Inside any place that serves alcohol for onsite consumption. (39-17-1305) 2. In any room where a judicial proceeding is taking place. (39-17-1306) 3. Schools. (39-17-1309 and 39-17-1310) 4. Public Parks and recreational property. (39-17-1311) 5. Any place with a properly posted sign per 39-17-1359

  7. Regardless of being armed or not, I don't think being a LEO should mean you can go just anywhere and everywhere you want to, even at places open to the public. If you have no official business there and it is private property (even open to the public) the property owner should be able to deny entry to you just like anybody else. Even more so if you are not in the jurisdictional area of the department you work for. Also...as a LEO you do not get to carry everywhere you go either. There are restrictions in 39-17-1350 very similar (but not the same) to those for us with a HCP, the biggest difference is that a sign posted per 39-17-1359 does not apply to LEOs.
  8. Yes, but you could still be charged with violating the city ordnance of discharging a firearm. It would be up the local police and/or judge as to charge you or not. Also, and I don't have time to find it now, but as far as "hunting" laws go, there is a minimum distance you must be from a residence.
  9. I think the McCain aides would do well to listen to Palin. I think the GOP would do well to switch the Ticket or even just move Palin up and let her find herself another VP.
  10. Not sure what you mean. You made the above post. If you are talking about in the trading forums, you should have never had the ability to post a WTS ad before you had 50 post or became a benefactor. Note: You can post WTB ads with any amount of post.
  11. I would not see such an order coming from a state level official, but a Sheriff/Chief of Police or local guard commander, it is very possible. I'm sure any of us that have lived in small towns have seen officials feel they can make their own rules. So I would say most would carry out the order if given. But an even better question may be, "How many LEOs/Guard would even know it is against the law?" ...and maybe a better question yet is, "How many of us would comply with an illegal order to surrender our weapons or not carry in public?" I'm sure the first reaction is to say, "No, I wouldn't comply", but how many would actually be prepared to either be arrested or even possibly have it escalated to a higher level?

  15. The unloaded weapon or the ammo can be close to you and the other must not be readily accessible. But I believe a loaded weapon anywhere in a vehicle that your in would be considered in you possession, readily accessible or not. ...and other than the reasons we have discussed you can not have a loaded long gun in your possession. Just my EDIT...I'm not crazy...this was a reply to a post that is not just a dot (.)
  16. I completely understand your frustration of the law. I would also wager that you aren't the only one that would make the same choice on this board. However.......we try not to allow the posting of committing or intending to commit blatantly illegally activity.
  17. I think you are right...I too could be wrong but I think the incident to means the possession is incidental to the activity. Like you incidentally have a loaded rifle because are hunting...not on the way to hunting. Thoughts?
  18. You're right in that a HCP only applies to handguns. The law DAS quoted has nothing to do with having a HCP or not. But I agree there is some debate whether the defenses in 39-17-1308(a) mean actively engaged in those activities or not.

  22. He got the info from the Chattanooga what? IANAL and do not claim to know everything about the law, but I can read. The laws says you can not carry within the confines of a building where alcohol is served for onsite consumption. If alcohol is served in the restaurant portion as it is in Red Lobster etc...you can't legally carry there. OS is right in that most states that allow carry in the restaurant area but not the bar area of a place specifically say that in the law. TN law makes no such distinction. If what this Sheriff and HCP instructor say was true...we would not have been a legislative watch the last two years hoping for the bill to pass that would have allowed carry where alcohol is served for onsite consumption. One of the very reasons the law didn't pass in that in TN law there is no legal definition of a bar. So there was now real way to allow carry in a restaurant that serves alcohol and not in bar.
