  1. I believe that to be 100% wrong, period, no matter who said it other than the state AG.
  2. 39-17-1310 Affirmative defense to carrying weapons on school property. It is an affirmative defense to prosecution under § 39-17-1309(a)-(d) that the person's behavior was in strict compliance with the requirements of one (1) of the following classifications: (3) A person possessing guns or knives when conducting or attending “gun and knife shows†and the program has been approved by the administrator of the educational institution
  3. There are two AG opinons that say it is illegal. 07-148 (Question 3) and 08-26 reaffirming the previous opinon after questions were raised. There were also bill introduced last session to allow carry in state parks that failed. So although to many (including myself) the plain reading of 39-17-1311 does not prevent handguns in parks, it would seem the AG and legislature disagree.

  6. Yes...I did mean more to what degree or guilt of homicide. I apologize for not being more clear. Also I just want to remind everyone...I have never said I wouldn't or that anyone else shouldn't give a statement. I'm just saying that you don't have to while everyone is still standing over the body, if you don't want to. If you want to....say what you want to say. If I feel my statement will help the DA determine it to be self-defense I will give my statement as soon as I feel I can. Let me ask you this. If your best friend just knocked the crap out of you, just out of the blue. Then someone asked you how you felt about it..and your answer would determine the rest of your friendship with that person... would you want to answer why you are still stunned and hurting or after you have had time to collect your thoughts?
  7. Yep...that about sums it up. Although I haven't seen it recently, many are saying the video provided by the state to use in the class has not been changed since the law was changed. However I think most instructors address this...or should at least.

  9. True if the DA rules it self-defense it may go nor further. Even if he presents it to a grand jury they still don't determine if a homicide has been commented or not, simply that there is enough evidence to bring a charge. Only a final ruling by a trial jury or judge will determine if it is a homicide or not. My point is the people on the scene are not going to be the ones to legally determine it is a homicide.
  10. That last part may be true, if only the bar is licensed to sell alcohol for onsite consumption and the restaurant is not. I say may, because I have seen when they do Health Dept scores of giving a different one to the bar area and restaurant.
  11. According to 39-14-212©(12) it is not aggravated cruelty to an animal to "dispatch a wild or abandoned animals on a farm or residential real property"
  12. A homicide is a determination of fact to be made by a jury. It could be anyone that I just killed, that is why the police have to investigate it. If it was a good shoot, then I will tell them that. I will damn well go and come as I please, if I am not under arrest. Of course I will say/do what I feel comfortable with at the time to keep from being arrested. It is the very fact that I have worked in (deputy sheriff and reserve a while before that) and close to law enforcement (dispatch, EMS, FD and Rescue) (also have family currently in law enforcement) as to why I won't simply bend over and stick my a$$ in the air and what to have a LEO d**k rammed in it. But at the same time I'm not going to be an a$$hole to them either and will cooperate to the level I see fit as long as I am within my legal rights.

  17. Why do you have to do what the "tell" you? (The rest is not directed at any specific member) While I think most of us are in the middle (me included) when it comes to interaction with LEOs we definitely have two extremes.... One let the police do what ever they want, search for anything everywhere they want to, if they "jump" ask, "how hi?" on the way up. The other is not going to speak unless spoken to, show no courtesy, do absolutely nothing they don't have to. I admit I probably slightly lean toward the later from the middle....but people in the two extremes kill me..
  18. But at breakfast it could be served, on Sunday it can not. I understand what you are saying about being the only in there or the fact that no one is currently drinking alcohol, but the other 6 days of the week they could...so alcohol is available to be served. However on Sunday it is not even available to be served. Yes it is in the building, but as we know it is not illegal to carry where alcohol is simply located.
  19. Let me clarify...If I choose to give a statement at that moment. Yes, I know at some point I need to tell my side. Never said I was refusing to give a statement completely. But it does not have to be at that moment. It may be after I go to the hospital, had a nights sleep, talked with a lawyer or any combination of the three. Or depending on the situation I may give a statement right away. If they have enough to arrest you they are going to do that with or without a statement from you. Contrary to popular beilef....there are still some rights afforded to the citizens of this country.
  20. I think it goes back to "served" Alcohol is simply not served in that restaurant on that day. However violation of 39-17-1305 is a misdemeanor not a felony.
  21. It is nice, I was born here in Hot Springs but parents moved when I was less than a year old. As a child we came here all the time to visit my grandfather though.

  23. Been on the road since Thursday morning taking my mom to visit people in OK, TX, NM and AR. Heading back home in the morning, anyway.. Was looking on the web for a place to go eat tonight...finally decided on The Dixie Cafe (I would recommend it to anyone) after looking at the menu online. We had already ordered and been there a little when I noticed a small sign on the table that they now serve Bud and Bud Light on draft. (Was not on the menu online, the paper menu or anywhere on the door/window) Now if this was in TN I either have to go back out and lock my pistol in the car or keep sitting there violating the law. But being I was in AR...I just sat there and legally ate my meal with no icident....believe it or not!
  24. They are not going to take me, no matter what size town I'm in, unless they arrest me. If I choose to give a statement, I will voluntarily go and leave at anytime I see fit.
