Small, ears look pointed, snout too pointed, and nose is small proportion...so..red fox ? but missing "boots", although not all foxes have them. I "see" three legs (two front, & right rear), so not sitting.

Saw the rear leg now that you pointed it out and I zoomed the pic a bit

What kind of birds are the black and white one's?

Yeah they are magpies. Must be a photo from out west where they are very abundant. Trees look like western trees too. But I could be wrong.

Definitely a western location. Those are Aspen and Douglas Fir. Probably an elevation between 4,000 and 8,000 ft. Western Co, Wy, Mt, Nm, somewhere like that. I worked in western CO and it was loaded with magpies
