  1. Here is a court case where the trial court said Aggravated sexual battery (39-13-504) did not constitute "serisous bodily harm". However!, the appelate court said... This case involves a child and the last part of the quoted paragraph talks about age, but the highlighted part would seem to be saying that any sexual offense, regardless of age of the victim, would constitute serious bodily harm.

  11. I had just sent an e-mail to the TWRA asking about the effect HB0961 would have on their "No handgun carry" policy. They wrote back and basically said they could not comment until it became law.
  12. The primary purpose of the bill was to allow those have have HCP to be able to keep their carry gun on them while hunting. Previous law did not allow this. Also, though I never clearly saw it anywhere, apparently TN law prohibited carry in National Forest, although Federal law didn't. This bill removed any state law against carry in National Forest. There is no restriction on OC or CC, per state law, in the places that this bill allows for carry in. The topic of National Forest has come up because they are not covered by the Federal law that will go into effect in Feb 2010 that will allow carry in National Parks. There is no Federal law against carry in National Forest. However as has been said, Rangers can issue "special orders" for the land/area they are responsiable for. Some of issued Special Orders to prohibit carry in places under their control, such as Land Between the Lakes www.lbl.org Also some lands are under more than one jurisdiction, such as Cherokee National Forest....since part of it is a state WMA, carry was prohibited there by TN law, regardless of Federal Law or restrictions. Now TN law does not prohibit carry in WMAs or National Forsest and Federal Law does not prohibit carry in National Forest, so the question is, had the ranger in charge of CF issued a special order that prohibits carry.
  13. Sounds like the Nashville office knows the story. I am at work today, but I will resend my previous e-mail and ask again, just to have something "on record". As far as CF...the new law does allow for carry in National Forest maintained by the state, to the extent allowed by Federal Law So HB0961 does remove any state law against carry in National Forest (also like HB0716) but Federal Laws/Regulations still apply. And has already been discussed, it seems some in charge are using part of the CFR to issue "special orders" to prohibit carry.

  16. AFAIK it is somewhat standard practice at any gun shop to request any firearms being brought in for repair, to be traded or in any othere way that may be handled, to be unloaded. But I don't personally know of any that prevent you keeping your carry weapon on you. Some have posted signs to try and relay the above, but I've heard some were worded a bit confusingly.
  17. Local goverment already has the right to post other property it owns, city hall, police dept, fire dept and so on. All this really does it let them do the same for parks as they can any other property they own. Yes, I would have rather seen all parks legal and no opt out, but it just would not have passed like that. At the risk of sounding selfish, it looks like I will be able to carry in any of the local parks I will normally go to. That would not have been possiable if the bill would have failed. I have to agree with Phantom6 some. If you don't want your community to opt out...you need to talk with the people that control that. I have talked with county commisioners of where I grew up and city councilmen of Jackson, where I visit and Milan where I live now. One voice probably won't make a difference, but one of several is better heard.
  18. Not to side track any further, but there have been bills to allow handguns in Legislative Plaza. The group that looks at bills and comes up with a fiscal note said additional security would havd to be added and so on and so on added such a fiscal note to the bill that it didn't move. So the key would be for the bill to specifically say something about no aditional troopers being hired just because of it.

  21. What training is it that you have that will make a VA permit easier? TN recognizes some training in lieu of taking the state safety course.
  22. I too have heard of new permits being issued in just over 30 days. If you are a TN resident....at best, you are simply delaying having to get a TN permit by 6 months. Not sure what a VA permit cost, but then you'll have that cost plus either another $50 or $115 to TN when you get the TN permit. Handgun Carry Permit Application Requirements So I see no way around getting a TN permit if you are TN resident...it's either now or later.
