Just read the article...correct me if I'm wrong but the employer who fired back stated he did it as the shooter was leaving the store...I bet he gets in trouble for that.

He is an active shooter that just killed a guy and he is still an immediate active threat; a cop could shoot him, I don’t know why the employee couldn’t….. but you just never know anymore.

As I understand, the assailant shot Larry, and turned his gun toward owner, who dove into office to regroup, then came back out firing.

How would you know shooter is not coming back ? If he is still in sight, he is a threat.

As to shooting through the window, if someone has fired in anger and still retains that weapon, they're still an active threat. To you. To others around them. And, likely to themselves. Just because the muzzle isn't pointed at you right then doesn't change the threat.

I was just about to post up the link to the DA considering charges in the Smyrna case for shooting at the guy as he drove off, when I saw your response.

there's more protection and rights for these criminals than the people they hurt. if someone commits a violent crime, the victim defending him/herself shouldn't be charged for shooting back, even if the perp is retreating, going the other direction, threw down his weapon and tucks tail and runs.

I hope they don't charge him because he doesn't deserve it, even if the criminal had died, the employee wouldn't deserve to be charged.

by this flawed logic, a criminal can walk into a place, shoot someone, throw the weapon down and run out the door and you can't shoot them. stupid.

criminals should think about the consequences before they act, and retreating should be no relief from death or being shot once they attempt to commit or do commit a crime against someone with a weapon.

he shouldn't, and I hope he doesn't, but you know how it usually goes, the criminal has more rights than the defending victim these days.
