  1. It has to be on a public road or highway, or street or alley, a parking lot-type area, or "any other premises that is generally frequented by the public at large." It is not about the privilege of driving, it is about the right to be free from unreasonable searches and seizures. A blood draw is a search (and a pretty invasive one), and it can be argued that a breath test is also. Not sure that it'll work, but some top DUI lawyers I know have even talked about challenging implied consent this way.
  2. So regardless of what type ammo you shoot, how many rounds will an AR barrel last? I'm not anywhere close to needing it now, but I figure it would be a good idea to have a spare upper just for backup, especially if (rather WHEN) there's another shortage. And what about AK barrels, where you can't just drop in a new upper? How do those hold up to 10,000 rounds of all-Soviet ammo?

Like it or not that's our constitutional system.  Juries frequently have a different perspective on the case than the media-driven public because they don't have the same information.  They're just looking at it through a different lens.  It's hard to accept sometimes but they have their reasons.  A classic example is the OJ trial.    If anyone is to blame maybe it's the prosecutor.  They had the burden.  What did they not do to get a first-degree murder conviction?  I take it that's what defendant was indicted on. 
  5. My goodness but that's cute!!   On a serious note, if you do take one of these pups, please get him/her fixed unless you are willing to take on grandpups in a few years. So many heartbreaking stories of animals being sent to the pound would never happen if people spayed their pets.  Smith--is it too late to spay mama?  I think that should be done.
  6. Opie was also in Saving Private Ryan.  He played the soldier who'd lost his hearing because a shell had gone off too close to his ear, and Capt. Miller was trying to have a conversation with him about Ryan's whereabouts.   I don't have real tv so I have to wait for SOA to come out on Netflix.  I'm still waiting for season 5.

Assuming he has a tax stamp for that silencer and that's what he tried to introduce, I'd like to know why the judge did not allow it.  No question, Embody is being a complete knucklehead, but it was wrong for the judge not to consider the evidence.   Embody's about to find out that you never, ever want to let a small problem turn into a big one.  If he'd spent a few thousand and hired a lawyer it probably would have gone away.  But this is not his first time around this particular block.  People like him, I think they get some kind of sick pleasure out of it.  They enjoy being reamed through the system.  You just can't reason with them.

SG Ammo has the Golden Tiger, 1000 rounds for $250 and $22 shipping.  That's about the same per shot, maybe a little better, than the Tula at WM.    Ammo is always going to go up in price, regardless of who's in the White House.  It just goes up faster when there's a Democrat.  But it's like gasoline.  Just like it.  Long term it's only going up in price, and we will pine for the days when it could be had for pennies.  Remember when gas was a dollar a gallon?  Without gasoline a car is useless, and without ammo a gun is useless. 
  9. If you plan on getting into reloading, keep them.  If you wanted to sell them you might could make some beer money.  Probably not much more than that.

Long on speculation and opinions, short on truth or accuracy.  He makes it clear that he has no faith in the 9mm, but then admits that he's probably never seen a wound from a good 9mm duty load, only those from cheap fodder like Wolf or WWB.   I'll stick with DocGKR's work, which has been tested and verified. 
  11. This could go on for a while.  Maybe we should have subcategories for best movie for a particular war.  Like, best Revoutionary War movie.  Hmm, The Patriot?  Mel Gibson as Ye Olde Road Warrior.

I actually thought the first five and last five minutes of Private Ryan should have just been cut out.  It was nothing but sentimental crap, but you're gonna get with Spielberg.  Most of the rest though, was excellent.  Just as Unforgiven is the best western in my opinion, SPR is the best war movie.  Those two just blew away everything else in their genre over the previous 40 years.

First offense in Tennessee is mandatory minimum 48 hours jail, second offense is 45 days.  It goes up from there.  I don't know if the legislature will ever increase the jail time.  Before 1989, sentencing in general was a lot tougher in Tennessee.  DUI penalties do keep getting added each year, but it's always for collateral things, like mandatory blood draws that Dave mentioned.  But even those are being called into question with the Supreme Court's decision in McNeely.  At least the ones done without a warrant.  The latest is that in order to get a restricted license you have to have an interlock installed on the car.    It's all about the money with DUIs.  Interlock, probation fees, scram bracelets, all that shit costs money.  Those industries have an incentive to not put people in jail, and they lobby Nashville accordingly.  So I think that might be part of it too.

A few years ago I took an intermediate pistol class and a guy was using a 92 variant.  You could tell he didn't have much experience with it.  Kept fumbling the decock and forgetting to return it to safety off.  He was always behind on the drills and starting to slow the rest of the class down.  He left after a couple hours and didn't come back.   I felt kind of bad for him but that was the right thing to do.  Could've been a safety issue.   I can carry my M&P compact one day and my 92fs the next.  It's no big deal, got lots of tt with both.

I would like to switch out my Beretta 92fs (which I rarely carry but it is my primary 9mm sidearm) for a 19 or an M&P 9, but that would be a lot of investment in new magazines.  I have 14 mags for the Beretta, most all are factory or Mecgar, and I didn't pay more than $20 for each.  That was pre-panic of course, purchased over several years.  But I'm not paying $30 for a standard cap pistol mag.  Maybe they'll come down in the next year.

Federal Fusion 62 gr. is well-regarded in short barreled rifles.  Check out this thread: http://www.m4carbine.net/showthread.php?t=73955.   I've got an 11.5" and a 16" AR and I think the Fusion would be ideal in both, so I just ordered 200 rounds from Palmetto State.  They've got it for $17 a box of 20 this weekend.

  19. http://www.cbsnews.com/8301-201_162-57594073/ex-n.m-police-officer-acquitted-of-murder-of-wife/   A former Albuquerque police officer clutched rosary beads, made the sign of a cross and hugged his lawyer Tuesday as he was cleared of charges he murdered his estranged wife and made it look like a suicide in order to free himself from a volatile, adulterous marriage.   There was a bullet in the gun's chamber when it was found next to her body, and the magazine was no longer attached to the weapon. Prosecutors contended it would have been impossible for the woman to press the button to release the magazine after shooting herself in the mouth.   If it was indeed suicide I would like to know how she was able to press the magazine release after pulling the trigger.  They say it's impossible but I don't know, it could be.  You hear stories of people being shot in the head with a 44 mag or something and surviving.  One of her fingers or thumb could have jerked at the last second.  Story doesn't say where the mag was found.  Right next to her I suppose?    But that's a heck of a job by the defense.

  22. Dave hits it on the head. The money. And not just from defendants. Federal money. Grants for highways and such. It's what they did to get everyone to go to .08.
  23. O Shoot, yes it's one year license revocation for first offense or for violation of implied consent. Restricted license avail for work, school, interlock appointments and court ordered functions like alcohol class. With CDLs it depends on the state. Tennessee doesn't have a lower threshold but in MS it's .04.

Yesterday the NTSB announced it's recommending a lowering of the limit for under the influence from .08 to .05.  I'm a member of a national DUI defense group, and everyone is talking about this on our listserve.  A lot of arguments similar to the ones gun owners make regarding tougher gun laws.    http://duinewsblog.org/2013/05/14/ntsb-wants-to-lower-dui-limit-to-0-05/     I read in one article that the alcoholic beverage industry has already fired back.  Of course they don't want this happening.  Now instead of having two or three drinks at a bar, a person might have just one.  On just a personal level I generally despise any sort of new laws, and like tougher gun laws I'm not sure that lowering the limit would make the streets any safer.  But it would certainly be more business for us defense lawyers.
