  3. There doesn't seem to be a law that says they can't post, there just isn't one that says they can. So a posted sign carries no weight of law. Sort of like NV and other states where OC without a permit is legal...it isn't necessarily legal because a law says it is...it is legal because there is no law against it. The links OS posted are good ones to research. Here is a direct link to NV laws on weapons.
  4. I looked...don't think it does...was editing my post as you sent this I guess. To be honest I wish there was a BAC associtated with 39-17-1321, but I don't see that happening anytime soon. Many other states either have the same BAC for carry as they DUI or it may be a lower one. But either way it is not just up to the discression of the LEO.

It's not in the new part, because it already part of 39-17-1305 ....if you are not complying with all parts of 39-17-1305 (in a "restaurant" and not consuming) then you are in violation of 39-17-1305 which is a Class A misdemeanor. Being under the influence can have a BAC which means it is assumed you are under the influence, but it doesn't have to be a certain BAC. 55-10-401
  6. You need to re-read the bill.... Public Chapter 339 The new 39-17-1305©(3)(A) As far as 39-17-1321 that you mention, for when you are not in an establishment that serves alcohol, it seems like I've heard that most LEOs would take that to mean ANY influence.

  8. I understand your frustration....and agree what is going on with the ex's boyfriend is not right. But having worked for a small county Sheriff's dept as a jailer (not the county I'm in now) it is not uncommon for a trustee to have extreme privilleges...even sometimes with the knowledge and/or help of the sheriff (not saying this is the case here though) But...as far as calling and asking for the Sheriff...I will say you might be surprised how many people call and ask to talk to the sheriff, even about the neighbor's dogs barking, music too loud or other minor things, instead of simply asking for either a deputy or for a car to respond. Also I imagine even if you had talked with the head jailer, had you not given your information I doubt much would have been said or done, although I would guess they already know for the most part.
  9. Correct, only those with a HCP. Others must still keep ammo and firearm seperate and the ammo not be in your immediate area.
  10. One difference is that when you had a loaded magazine next to the gun before, it was illegal, because it was still considered loaded. Now it is not illegal.

  12. As long as you have some sort of sheath or scabbard for the long gun not sure what the problem would be. I agree leaving unattended in anyway, even secured, may not be the best idea, but otherwise...what's the big deal?
  13. I pocket carry a Glock 32. As others have said...I'm a big guy, big pants, lots of room in the front pocket. Much more comfortable than IWB for me, plus it tends not to conceal real well. The other choice is OC, which I do on the rare occasion.
  14. Yes, as long as there is not a round in the chamber. The law specifically says.. "transporting a rifle or shotgun in or on a privately-owned motor vehicle" See Public Chapter 435

  16. Pretty much always carry...so that includes when on the bike. The only thing different I do sometimes, is use a shoulder holster if I'm going to be riding for a long time.
