  1. Looks like it has been on the books awhile. First encacted in 1937, last amended in 1974
  2. If you live in a city/county where the local goverment band handguns in their parks, keep a check on the state parks close to you. After a period of time where there on adverse incidents by HCP holders or maybe even where a HCP holder was able to defend themselves, you may get the city/county council to reconsider and remove the restriction. Probably wishful thinking I know, but worth a chance.
  3. Well I wasn't sure what to say. I knew signs for parks/rec areas and schools both have exact wording and minimal measurement requirements. However I had seen nothing like that for a 39-17-1359 sign.
  4. Goverment buildings (except federal) are not automatically off-limits. The must post. The one difference between goverment buildings and privately owned places is when the law was amended on July 1, 2000. When it was amended it said that any posting by a govermental entity that was already posted and was in "substanial compliance" with 39-17-1359(a) could continue to be used. So while I feel I know what is a legal and non-legal posting for privately owned property, I don't think I woud risk carry in a goverment building that had any type of posting where the intention to ban firearms was clear.

  6. Ah...ok. Well may go back to what other's said about the amount of time from when the button was pushed and the PD was notified. Should be able to request the dispatch information and see where the lag occured and go from there.
  7. Not sure how large a city you are in, but 5 minutes is not really a bad response time. (Of course look at my sig line) Also sounds like you may want to check with the alarm company to see what list of numbers they have to call and in what order. Sounds like calling your home and cell first would be ok for a break-in alarm, but a panic alarm should have the store's number first....well after the PD that is.
  8. FWIW Post 3 was from a lawyer... Post 4 was from a LEO.... Granted neither know the details other than what is in the post, but their thoughts may carry more weight than some.

I think someone mentioned in this thread (http://www.tngunowners.com/forums/tennessee-politics-legislation/22256-metro-davidson-council-seeks-override-hb0962-local-level.html) that Merto Legal already determinned the ordnance is illegal and will be pulled at the next meeting? Hopefully that is true, guess we'll find out soon.....

  12. The 10 days starts from when it is sent to the Governor's desk. That was done on Monday 6/1/09. To be honest I'm not 100% sure how they cound the days, but I guess that would make the 10th day on 6/11/09

  16. That is correct, at least it is the reason given. The real reason is, it would have cost to remove and/or change old signs. That would have added a fiscal note to the bill, which might have been enough reason for some to vote against it. AFAIK as long as you are on a public roadway, even if goes through a posted park, you are still legal. I work on large Federal instalation that has a state hwy going through it. As long as you are on the public roadway you are not actually "in" the instalation. Of course if any road is considered part of the park then the rules of the park would apply.

  18. I think JayC pretty much hit in on the head. Like he said, don't know of any case law on 39-17-1359. IANAL, but IMHO, the reason for the "substantially similar" wording is to allow the owner to "customize" the wording of the sign in the law to their needs. Owner/Operator could be changed to the actual name of the person or business. Weapons could be changed to just handguns or firearms. Property, or within this building or this portion of this building could (or should) be changed to list the specific area(s) off limits. If you say this property, then there is no real reason to include the word buildings. Or if you just want to ban carry in a certain room, there is no reason to say property or building. Other than those three areas I think the sign should have the rest of the wording as what is in the law. On another note....violation of even a proper sign (not recommended) is a misdemeanor and you could only be charged by an officer if it occurs in his presence. So if you are on the other side of the sign, when he gets there, not much they can do other than advise the property owner of warrant procedures if they want to follow through with it.

  20. Just to add, as long as you are still on a public roadway, you would not have to stop and disarm and/or unload your weapon if you are just driving through the park.
