  1. bkelm18 is exactly right about the "served" as opposed to "sold". IMO though if you are bringing it yourself, it is not being served to you. Just remember IANAL nor did I sleep at a Holiday Inn Express last night...

  6. IMO a sign that simply says "Firearms Prohibited" does not legally meet the standards of 39-17-1359
  7. Who did he receive this letter from? There basically only 5 places that are off limits to carry by law. 1. Inside of places that serve alcohol for onsite consumption. 39-17-1305 2. Rooms where a judicial proceeding is taking place. 39-17-1306 3. Schools. 39-17-1309 4. Publicly owned parks and recreational property. 39-17-1311 5. And any place where the property owner post signs in accordance with 39-17-1359 So I really have no idea to what law he would be referring to.

  11. I have recently moved...again.... but anyway. As I was calling my car insurance to change my address etc... the lady mentioned their renters insurance and asked if I would like a quote. I figured sure, I haven't got any yet. She asked the standard questions about a fire hydrant, trees and so on. But she also asked if there were any firearms in the house, how many, if they were kept loaded or unloaded and if they were locked up or not. Now the only firearm I have is my carry gun and it is loaded and not locked up. She said it would have to at least be kept locked up if not unloaded and locked up before they could issue a policy. I fail to see how the status of a firearm would affect a claim because of fire or the like. I checked with my mother, she said the place she uses didn't ask anything about firearms. I have never rented so therefore never had renters insurance before, is this a standard question and/or requirement? Every couple of years I check car insurance quotes from other companies, the place I have now is usually always the lowest or they are only a few dollars more, not worth going through the change. But now I am considering changing companies when this policy expires in addition to not getting their renters insurance.
  12. Just to clarify the law doesn't say that "every" entrance has to be posted, just the ones that are "primarily used". If their intention is to only ban carry within a certain building then it must be posted at "including all entrances primarily used by persons entering the building, portion of the building or buildings" If they intend to ban carry anywhere on their property (pakring lots as well as buildings) it must be posted at "the notice shall be posted at all entrances to the premises that are primarily used by persons entering the property."
  13. There is no law that bans carry in hospitals. They have to post a sign under T.C.A. 39-17-1359 like most other places. Speaking of the someone...I always love when someone says "they just passed a law" when the legislature is not even in session....
  14. +1 While I would never make a statement to the police or in court that it was my intention to kill someone.....like you said, duh. In court or to the police it is, "It was my intention to stop the threat." A laser sight, certain ammo, caliber of weapon, etc... was simply to help me accomplish that goal.

  17. Yes, I believe the SCOTUS ruling said the 2A is an individual right. But they also said that it is subject to "reasonable" restrictions. The only way to answer whether registration, a carry permit or anything else is reasonable would be a lawsuit on each restriction. I do think I understand the point that Dave is trying to make though.

  22. Legally they can even prevent you from having it in your car on their property. But they can not search your car without your permission. However they can always tell you to get your car off their lot and have it towed if you don't move it. There was a bill introduced to allow HCP holders to be able to leave their weapon in their cars even if their employer or other business prohibited firearms....it didn't pass.
