  1. Actually the point is moot now....as that is no longer the law and 39-17-1359 signs do not apply to LEOs. HB0898 that became Public Chapter 605 effective July 9, 2009 removed that restriction in 39-17-1350© for LEOs. That is also the same bill that prevented beer boards from requring a place to post to be issued/keep a license.

  3. No. The whole point of the sign is you can't carry past it. So you would have been legal in the foyer area, but not in the restaurant. Guess they are giving you a chance to get out of the rain/cold before you look for the sign.
  4. I think that is simply the default sig line when using TapTalk. It says "Sent from my (device name) using TapTalk. Not sure if it can be changed or not.
  5. I don't always, but usually do so that when I leave the house I don't have to get it then, also mainly so that I know it is secure when the kids/grandkids are around.
  6. No worries... ....and I do agree that in these type situations good, deep concealment would be most prudent. Oh.....If the plumber draws on your first.....go ahead and blast him.
  7. Did you not read my post just above this one of your? I did not say you should allow an armed stranger in your home, I also did not say you shouldn't ask them to leave. I just questioned having to ask them to leave at gunpoint.
  8. I don't think anyone was saying much either way about allowing or not allowing someone in with a gun or even about telling them to leave. Just that it probably isn't necessary to ask them "with my 45 pointed at him, safety off."
  9. @Newbie as others have said, it is legal as long as it is not posted. Also not going to find a law that says it is legal, jut not going to find one that says it isn't either. I know AR and some other states require you to get permission from a home owner first, but TN is not one of them. @Will Carry I would suggest asking people before the enter or posting a sign if you feel that strongly, instead of having to feel that you need to pull a gun on someone to ask them to leave.

  12. Seems like a pretty straight forward answer to me....especially for a government attorney. She is say Yes, you can have the firearm in your vehicle as long as you do not handle it or allow someone to handle it with your consent...as long as the school hasn't posted the property per 39-17-1359. I assume she mentions 39-17-1359 because of your mention of signs. You may have meant the sings required in 39-17-1309, but those signs aren't what actually prohibits carry in the school, they only make you aware of the law. It is the law itself that makes carry unlawful. Unlike 39-17-1359 where the posting of the sign is what makes carry illegal. Although I have never seen a 39-17-1359 at a school, they could post one if they wanted. Since carry in the school itself is illegal even with a permit, the only place I see them posting a 39-17-1359 would be at the entrances off the road. Also while it may be legal for a teacher to have a handgun in their car...it could still be against school policy and subject the teacher to punishment through the school.
  13. Maybe.... I don't see anything in MS Code or on the website...but there is nothing in TN code about transferring from another state I don't think and the DOS only posted their requirements for transferring from different states recently...
  14. LOL...well I understand, but there are cost associated with moving (I hate moving!!) and this may be one of them. But if you are moving to MS and going to be a MS resident I imagine you will have to get a MS permit. From looking at the MS state website it looks like all having the TN permit now will help you on is the not having to wait 12 months after establishing residency before you can get a permit. {MS Code 49-9-101(2)(a)} Firearms Permit Unit - > § 45-9-101. License to carry concealed pistol or revolver. It also looks like the total cost will be $132. Sorry.

  16. T.C.A. 39-17-1357 says you are supposed to notify the Dept of Safety within 60 days of an address change. Since you would then be a resident of MS, but already have a TN permit I'm not 100% sure how 39-17-1351®(3)©(i) would apply. It says... Other than the above situation, TN does not issue Non-Resident permits. In all honesty, now that TN honors all other states permits, I'm not sure why this is still even in the code. It may get cleaned up at some point. Of course who knows, TN may start issuing Non-Resident permits for revenue.... This may be something you want to ask the Handgun Permit office in Nashville about. Handgun Carry Permits Why would you not just get a MS permit? As far as the lower, I agree I would probably wait till after the move.

Well to me they way it is worded about notifying the principal or someone in the principals office implies those times where you would find someone in the office, which is not likely at 7:00pm Friday night. As to me at least that is not "regular" school hours. If the legislature had wanted to include school activities, they could have used that language as well. But I agree others could see it different I guess.
  18. That is wrong.... It does not have to be a restaurant. SB3012 completely repealed 39-17-1305. So you can carry ANY place that serves alcohol for onsite consumption, so long as it not posted per 39-17-1359 and you are not consuming.
  19. None legal/binding signs don't mean anything to me. If a place has a sign that says "Management not responsible for bad service" does that mean you won't complain if something is done wrong? FWIW the new law (SB3012) also removed the requirements that places post the ABC signs. How soon they'll come down, who knows?
