Transferring while another on appeal

I purchased an ar lower about a month ago. Things got a little delayed with getting it shipped so it just came in this week. I purchased another lower last week.

 

The first one came in this week an tics denied. I seem to get hit with a denial about 1 and 7ish. It's been a couple days since I appealed and it's still not reversed. I received a notification the second one shipped this morning.  

 

Anyone know what's up with transferring a firearm with another on appeal? I'll speak with my FFL but wanted to see if anyone on the board has experience with this.

I've got no idea, but I would also like to know the outcome of this also. Knock on wood but I only got one denial about 8yrs ago and it was turned over the next day for approval, someone will be able to answer you if you talk to your FFL report back and let us know what they say. Good luck

I'll keep everyone posted. Hopefully the first gets overturned before the second is delivered. Like I said in the initial post about 1 and 7 get denied. I've got 8 form 4 stamps, 9 form 1 stamps and a carry permit. I've never met anyone with the same last name so it's obviously not very common.

I haven't done a lot of firearms transfers. Probably 40ish and getting denied every 7 or 8 sucks.The last transfer was probably three months ago without issue. Just gets old and there's really nothing a person can do to help move the appeal along and no one really wants to help. I'm leaning towards applying for a upin. I'll contact FFL if not approved once the second is delivered.

Is there way to clear up the issue that is getting you flagged? Not trying to ask your business but if it something you could get fixed like maybe a disposition to a case that was never sent in might be worth the hassle to get someone to do their job.

There's just nothing to clear up. Never been arrested charged indicted sued accused etc. never nothing. No issue with tax stamps, carry permit just random firearm transfer denials. Could be a name thing but again pretty unpopular last name. Because if there was something in my past I'd at least know where to look into. As long as this denial gets overturned which i believe it will at some point I'll be patient one more time but if it happens again I'm going to get a upin I guess. I don't care how many firearms, serialed lowers, cans, stamps I still get relatively excited when it's time to pick up. I spend a lot of time and money "designing", acquiring and assembling all the parts and pieces for my rifles so it's disappointing to say the least when this happens.

 

I've read about some ways to see what's going on but it involves a lawyer and/or more government red tape. I'm certainly still open to suggestions other than just crappy luck I guess. Most of the dudes at the FFL are okayish but even the cool ones don't really give a damn when you get denied nor have an intention of trying to expedite the process by making a phone call that I can't. I'm eventually going to get my own license. I just want to add some more security measures to the house before I apply just to help with the approval.

 

And the biggest load of crap of all is they can deny you a purchase of a firearm but will not inform you as to why. Utterly ridiculous.

That sucks. Good luck with it. I almost wonder if you have some matches to someone with a criminal record and it's flagging you like an alias or the same person. I mean I've seen criminal histories over the years pull possible matches with same names and DOB similar or pull alias the suspect used with a dob that actually is a person. Once that gets entered its there forever. I mean within 10 minutes of reading it usually a human can tell its not the same person when the confirm everything to the other pages. Either way good luck it's a shame it happens.

Seems like I read on here once that with the SS number bring optional when doing the tics paperwork, more false flags come back if you don’t include it. If you don’t include yours, you might think about doing that.

The above statement is true, I used to help out at a couple of shops awhile ago. I had several buyers not put their ss# down and I tried to explain that it's 50% going to be pending/ possible denial and that usually happened.

I've never listed my social.  Never denied, ........ well not purchasing a weapon any ways.

TICS auto populates your SS number when we put in your DL number. Putting it on the form does nothing other than allowing us to have it on file or verify it matches what the system shows.

Alright the appeal was overturned six days after it was submitted. Which was the day before the second came in. The dealer said they would have ran the second even if it hadn't been overturned. I do always include social security though. I can only assume it's either bad luck or someone with the same name issue but again very very uncommon name. Anytime I mention it I get the standard "it happens a lot" response and "Tennessee has the highest denial and overturn percentage". As if that makes it any better even if true. Anyway thanks folks I enjoyed my first post on Tennessee gun owners.

 

Edit: Odd thing is on the second one it was taking so long to process the employee had to call tics/tbi to see what was going on. Like I said above it got approved but still just one more thing.

Glad it got worked out, it's a heck of a feeling when your standing there and a bunch of people are in the LGS and you get a pending, or denial answer. It's probably due to the name that's similar.
