Sure one could be arrested (cops have alot of leeway with regard to what they can do, and how loosely they can interpret something as a crime). But the sign wouldn't hold up in court. Just depends on what is of more value... your life or your temporary inconvenience.

As soon as I have another option with regard to telecommunications providers, Charter won't be getting any more of my money.

im going to be doing the same thing when i can get another option for cable. but right now its all i have. i could do with out my T.V but their is no way i could do with my high speed internet. Theirs no way im going back to dial up Internet :)

The sat companies are all bundling with DSL nowadays. It usually works out significantly less (comparing apples to apples) if you know how to play the game. There are several threads on this one.

Well… there you have your answer.

The AG as left the door open with the “substantially similar” language. It’s up to the cop. Obviously the signs conveys the message that they don’t want you to carry.

Trust me; you do not want the cost or the risk of going to trial on a weapons charge. Even if it is dismissed the arrest is still there.

You are the first person that I have heard of actually having an encounter with real cops over a posted building.

Great, another jackass cop who doesn't know the law and is going to enforce it as he interprets it. (Not meant for you Dave)

The AG's opinion clearly states that just a circle/slash sign without the "substantially similar language" doesn't cut it. And just "No weapons" ain't substantially similar.

So here's an interesting question: Even if the sign doesn't meet the legal requirements could you be automatically guilty of trespassing just for entering the property while carrying in spite of the sign? In other words, does such a sign act like a "Posted No Trespassing" sign?

No according to Mike one of the LEOs that came that day. He said all they can do is ask you to leave and not come back with your gun. But if they do like charter did and call the law and they make a report and you come back with your gun and they call the law he said you will go to jail for Trespassing.

i was just asking because the LEOs there said that i can not go in any business with that sign on it. and the next time i was going to jail.

One of the ladies that work for charter was out side when they were talking to me. And Mike said thats why he said i would go to jail to make them feel like he was doing his job to keep me from carrying in there. And if he would of said that sign is not legal with her out there she would probably of call the main offices and get them changed. So im gald he said what he said. :P

'Substantially' literally means "Largely but not necessarily wholly that which is specified".

That means if a sign has a majority of the verbiage specified in the TCA, it would be legal... but a circle & slash and a single sentace could not possibly be construed to convey a majority of the specified posting requirement... especially with out at least citing the code which allows the prohibition. Any lawyer worth his/her salt could tear the subject sign to pieces.

Sure, but the point is, why? If you see that 'illegal' sign and choose to carry anyway (despite the obvious wishes of the proprietor) and get caught, the only potential outcomes are:

1] they get legal signs, or

2] you get in hot water and spend a ton of cash essentially to accomplish the first outcome listed above while hopefully avoiding fines/further punishment.

Just not sure why people would push this issue - it makes HCP holders look petty and won't do a think to enhance our rights.

Because I'm not going to tip-toe around morons who can't even get a sign right. There are very few places which post at all in my area, and none correctly. If I see a sign, I sure don't come back... but if I'm already there, I'm doing my business and leaving.

Worrying about subjective 'gotchas' in the law will make ya' paranoid... there are thousands of them aside from just this one thing.

Also, with large companies, it's not just the local manager deciding on the sign, they have whole legal departments that scrutinize everything. It's been proffered before that they know they aren't putting up a legal sign, don't really want to inconvenience anyone, but if a shooting occurs they can say "well, we had a sign" when the inevitable lawsuit occurs.

We have a store here in Clarksville that sells hardware, fishing tackle, guns, ammunition and BEER. They have a sign on the door that states. "Beer sold here, NO CONCEALED WEAPONS ALLOWED". Needless to say, I have taken all of my hardware, shooting needs and fishing needs elsewheres!! I have a motto that "My money isn't welcome no where my handgun isn't. No matter how the sign is worded! PERIOD!

It states that on "Demand of the Officer you must provide your permit".

Did FL change their rules? When I lived there and had my CCW, I remember the law stating that you must inform an officer. I got pulled over on my motorcycle once, and I handed the officer my DL, my CCW and my military ID. Got off with a warning.

I think maybe some of you folks may need to spend some time as an " observer " in Nashvilles criminal court. I agree that the sign is not " to the letter", but an anti-gun judge ( if there is such an animal ) could seriously hurt your world here.
