On Thursday, Tracy C. Clark, 37, told Circuit Court Judge James G. Martin III, that he’d gotten into a verbal altercation at Westwood Elementary School on Jan. 30, 2006 after his 9-year-old son’s basketball game. Clark said the father of rival player came to his truck and held a knife as if threatening to stab him. Clark, who had a handgun carry permit, said he told the man he had a gun and pulled a 9 mm handgun from the center console of his pickup truck and put it on the driver’s seat. The gun was not loaded and never left its holster, according to Clark. “I never brandished it,†Clark said. “I never showed it. I did not know what the best thing to do was.†Martin said under state law regulating weapons on school property, Clark might have avoided a conviction if he had actually pointed the gun or used it because that would have demonstrated self-defense. “There’s no question he was in a situation where a man pulled a knife on him,†Martin said. “It’s an extremely unusual statute… in the defense side of it. While it’s illegal to possess a firearm (on school grounds) it’s OK if you use it to defend yourself.†Martin found Clark guilty of possession of a weapon on school property, a class B misdemeanor. The judge sentenced Clark to 20 days in jail, ordered him to take anger management classes and said he cannot possess or handle a firearm. “It’s ironic that, under the statute, if he’d have pointed it at him things would be different,†Martin said. “By his own testimony he didn’t display it or use it in self-defense.†In 2006, Circuit Court Judge Timothy Easter dismissed the charge against Clark, ruling he acted in self-defense. Last year, the state’s Court of Appeals ruled that Easter erred in dismissing the charge and remanded the case for reinstatement of the indictment.

    I see your point, however consider that anything that is not factory standard configuration can be used as an augment that you are a vigilante. For your consideration. How many gun owners have replaced their factory gun sights with night sights? If the prosecutor attempts to sway the jury that you are a bloodthirsty vigilante due to your gun modifications, then you and your lawyer will need to educate the jury of the positive aspects of improving the gun to allow accurate shot placement in order to prevent collateral damage. Even using hollow point ammunition may be used against you by a anti-gun prosecutor.

    To each his own. If using a lighter trigger pull allows you more accurate shot placement, then use the lighter trigger pull. As always, you need to exercise proper trigger control. That is, do not put your finger on the trigger until you are ready to fire. Remove your finger from the trigger and place it along the top of the trigger guard pointing your trigger finger parallel to the barrel once you stop firing. To me, the trigger pull is a personal preference when used with proper trigger control that you develop at the shooting range. Some people prefer the New York trigger spring pull of 11#.

  11. At one time, the HCP bill for restaurants tried to define a bar. That was removed due to it was unreasonable to expect the HCP holder to know what percentage of profit is made from food vs bar to determine the threshold of a "bar". IMO, I am glad the bill sponsor(s) removed that definition.
  12. I would recommend green front and yellow rear. The green dot will be the brightest and the yellow dots will allow you to quickly recognize from your peripheral vision if the gun is canted to the left or right of the green dot. You want to concentrate on the front site to the target and use your peripheral vision to adjust the rear sight to prevent canting the gun left or right of center.

The House had earlier passed the proposal sponsored Rep. Curry Todd (R-Collierville) that included an 11 p.m. to 5 a.m. curfew, and a ban on bringing guns into age-restricted bars. The Senate version does not include those restrictions. The Senate now has the option of agreeing to the original House version, or the a conference committee will be appointed to try to seek a compromise.
  14. This is part of life. You learn from your mistakes so that you do not repeat them in the future. I am sure in the future, you would now report this issue to the proper authorities even if the security vehicle were not at the scene. Well, some of us learn as we go through life.

If asked by the officer to secure my firearm, I would inform the officer that I am going to remove the gun and point it in a safe direction, remove the magazine, and then clear the chamber leaving the slide locked back to show the gun is safe. Then give the firearm to the officer. Given that you do not know the skill level of the officer and his/her possible lack of familiarity with your type of firearm, I would prefer to secure the firearm to prevent a negligent discharge.

  20. I agree. This probably would lead to more powder residue on the silver magazine tube that is extended beyond the barrel.
  21. Out of curiosity, what time in the morning did this event occur? Were the state troopers performing a sobriety checkpoint?
  22. Keep in mind that if criminals are able to see the holster in the car, attached or otherwise, they will think there is a gun somewhere in the car. This is going to lead to a lot of damage to the car as they try to locate the handgun.

  24. Can you step us through what this would mean if the bill is put into law? I am thankfully not aware of the process for protection or restraining orders. So to novice, it seems like you are in court in front of the judge with the order is granted and at that very moment you have to declare the firearms you own to be surrendered.
