  1. Counties can and do pass and enforce ordinances. I would check it on their website if they have one and this OpenDNS . This is a body that assist county governments in their ordinances and such. They usually have copies of their codes if you search.
  2. Those DOT laws are crazy strange you may have purchased a helmet with a sticker but I have heard of helmets not being legal and still having stickers. The best advice I could give is find a a trooper or an officer who is really trained and assigned to traffic to look at the helmet and ask questions maybe they can help you. Yes, your bike could have been towed. Your vehicle can be towed for many things regardless if your 5 feet from your house or 5 miles away.

  4. What exactly do you expect? Trespassing is a misdemeanor in TN. Due to that fact you either have to sign a citation as prosecutor if the department allows it or go take the warrants out yourself. Then Law Enforcement is allowed to make the arrest with the warrant. But I believe you should be good with that posting but you may want to double check TCA before you do.

  6. If it is "exactly" the way you say it isn't right. Did you contact TBI or contact NCIC/Feds? I have heard of people having issues with past convictions from several years ago and had to have TBI clear it up. If it causes an issue see if you can just get it expunged and take the court order signed to them and it will be gone forever.
  7. I will try to answer the best I can with the crazy late shift and lack of sleep. 1. What responsibility to the average Citizen does Tennessee LE have relative to preventing crime? I'm not responsible to the average citizen. I work for a city, the main welfare and protection as a whole is my goal. If I can protect one citizen daily good, if I can protect entire neighborhood great! 2. If someone is a victim of a crime more than likely they will not be entitled to any compensation from any LE department. But this is not for me to decide this is determined by a judge and jury. Typically you would have to show an officer to be extremely negligent and somehow purposely allowing someone to commit a crime that they know will endanger the public safety. Example I stop a drunk driver say screw it I'm tired allow him to drive off and half mile down the road he hits a family and kills someone. You bet that's probably gonna be a civil suit. 3. I don't know of any case law which would apply here. Most oaths of office never mention swearing to an individual citizen. I could be wrong on case law but never been shown to me. 4. I can't speak for LE as a whole or gather a general opinion about the 2nd. I commend citizens who enjoy their right to bear arms and do so legally. I don't always agree with firearms laws but that's above my pay grade. These may not be the answers you were hoping to get but you pose general questions and some that are not the general scope of Law Enforcement.
  8. The only laws I know in TN that apply to failure to report are Vehicle crashes, child abuse, and elder abuse if I remember correctly. Why would you leave? Even if your scared or nervous definitely stay there get your evidence in there so you can get the investigation over with quickly.
