  1. I agree (as a frustrated Murfreesboroan), the bill as written was the best we could get this year. It now falls to us to organize and "dis-elect" those who deny us our rights at the local level. They should rue their votes but once, and that continually (with apologies to J.E.B. Stuart).

Since the "Tennessee Hospitality Association" says that eighty-three percent of its members are going to post, I am beginning to think that the THA's membership consists mostly of family-owned or small business restaurants. There is no membership list on their website, but I base this on the fact that the site touts that joining them also brings automatic membership in the National Restaurant Association. Chain restaurants don't seem to be posting much (yet), and perhaps they are already members of the NRA (not the Second-Amendment one) at the corporate level. Since the new Tennessee law is already in effect in most other states where they already operate, the chains may not be caring much--it's business as usual for them.

  6. Blue Ridge Parkway is part of the National Park System: Blue Ridge Parkway (U.S. National Park Service) IANAL, but I don't think you will be able to carry there until February 2010. Federal "peaceable journey" laws are probably your only safe provision while driving on the parkway.

  8. I just don't buy the "unconstitutionally vague" argument. If a business has a restaurant liquor license in Tennessee, they are representing to the public that they are meeting the current state standard that 51%-plus of their business comes from sources other than alcoholic-beverage sales. If that is not truly the case, the remedy is to close their business IAW state law, not prevent law-abiding permit holders from carrying there.

  10. No, you are not wrong. The state law allowed carry in state and local parks, but gave localities the option to still post just local parks. It was just another very poorly worded piece of journalism...no surprise.

  12. This much shift this quickly tells me that the total vote count is extremely low...HIT IT HARD! Yes, I know these polls are meaningless, but you know they will crow the results from the rooftops if the results are against us....

  14. I don't OC either (most in my community would not be happy with a public school teacher OCing), but I also don't ever recall a situation where an OCer was specifically targeted. That doesn't mean it hasn't happened, but I haven't heard of one.

I understand what you are saying, however, even as a Murfreesboroan, I would rather be where we are now--knowing which six local people we need to "dis-elect" next election--rather than still having them stand behind "shield" of state law saying, "Of course I support your rights...truuuuuust me." Not arguing, just a different perspective.

  19. Another factor in this may be something that Jeffrey Snyder mentioned years ago in his article "A Nation of Cowards." When a man comes up to a woman, pulls a knife, and says, "You're coming with me," her judgment that a crime is being committed is not likely to be in error. Law enforcement must roll up onto the scene either after the crime has been committed or is in the process of being committed, when the criminal-victim determination is not so clear-cut.

  21. IANAL...my personal take: states have police powers, local governments are chartered by the state and are creatures of it, and hence can be "dis-chartered" any time the state so chooses. Theoretically, localities have nothing that the state did not give them. So, it is a "straw man" issue.
