UT Hospital not posted?

Unfortunately I have been at UT Hospital with my wife since Thursday. The entrance I have been using is not posted. Is that because all of UT is off limits and they don't have to post?

I just walked down and checked. The entrance at the fountain is not posted. It doesn't really matter since I assumed it would be and didn't carry. Of course I didn't expect to be here this long either.

Part of the UT school system and not required to post from what I understand.

Umm... I actually don't think it is and if it is part of the school it IS required to post what schools are supposed to post (which UT just ignores the law, surprise surprise.) My understanding is that the hospital is not run by UT but by some company.

Yeah, it's a separate corporation in some form or other.

And though it's a "teaching and research" hospital I rather doubt it could be classed a "school" in the sense of the carry statute; any more than regional offices of county agricultural agents, MTAS, CTAS, other extended agencies of UT would be considered a "school".

But don't rely on my opinion on it -- ultimately it's a serious consideration if it were to be found classed as school, felony as opposed to $500 fine.

Is the UT Hospital not like Vanderbilt Hospital? Does UT Hospital have UT campus police? I know UT has a medical school in Memphis.

Irony there: UT Police patrols off campus housing where I used to live (but firearms were not prohibited in residence, at least was not in the lease rules).

However, it's probably best to err on side of caution, and I'm even modifying my opinion. Been a while since I read 39-17-1309 and forgot just how wide ranging the prohibition is:

"...any public or private school campus, grounds, recreation area, athletic field or any other property owned, used or operated by any board of education, school, college or university board of trustees, regents or directors for the administration of any public or private educational institution."

This topic came up a few years back and it was stated that the hospital is part of the university so it doesn't even have to be posted. I don't know if that is correct though.

Schools have to be posted... Just a slightly different verbiage under a different section of the law.

Posting is not required for a prosecution for carrying on school property. Nor is failure to post a defense to being charged.

Per an AG letter, no case law on the subject that I'm aware of... unless you are?

Not a good plan, to push your luck... but it's going to be hard to prove that you intended to carry in a school, walking into a hospital.

Which is funny because by law they are required to post, yet if both parties break the law (school by not posting, and us by carrying) only we would be charged. It's a bad double standard that needs to be fixed (by eliminating the school carry ban.)
