Remember also, in many cases of self defense, the defendant does not actually have to use deadly force, but simply demonstrating you are capable is enough persuasion to alter the intent of a would be criminal. I have exposed my weapon on two occasions, and although I was prepared to do so, I was very thankful that I did not have to actually use it. I firmly believe that if you produce a weapon, you should be ready to use it, but I do not believe that you have to use it if you draw it. In my opinion, to demonstrate this force sooner rather than later, after the altercation has elevated to a level where you would actually have to use it, is probably better for all involved. I do not loose sleep over justified shootings; however, I am grateful that I have never been in that situation. Please don't confuse this logic as an argument for open carry, and Lord help us not to open that can of worms, again. I do believe that the element of surprise can work to your advantage, and you should always project an aura of confidence and control. Confidence in your ability and an understanding that you will be in control of the situation. Just for the record, I am a young, healthy 230 lb male, but I feel no obligation to try to fight someone before I show them that I am prepared to shoot their ass if they are intent on harming me or my companions3 points

There was a great article a few months ago on the issue of disparity of force and the simple answer is no, you don't have to be within seconds of death from a beating before you can respond with deadly force. The problem is that many DAs and juries don't always understand the concept of disparity of force and/or don't care and will prosecute anyway and juries may convict anyway. Remember, that in most states the standard is a "reasonable fear of death or serious bodily injury"...but it might fall on you and your attorney to educate a DA and/or a jury about why the 200lb 60 year old was in reasonable fear for his life or injury from a beating he was getting from some unarmed 180lb 16 year old thug-want-a-be (especially when the thug-want-a-be's pictures on Facebook are all replaced with pics showing how cute he was when he was 12. ;)3 points

If someone is threatening for a while then maybe authorities should be called. If your out minding your own business and someone just attacks for no reason I say it is life threatening. If your talking smack back and forth with somebody then are about to take an ass whoopin, take your whoopin.2 points

According to THIS ARTICLE, he denied having any guns. When he finally did admit to being in possession of firearms, he said they were not loaded. Some of the guns were loaded. He didn't come back to attend the trial. He was arrested in Maine in 2008 and charged with threatening his first wife with a gun. None of this takes away from the fact that NJ should be cast into the ocean, but this guy is a moron.2 points

Who is saying you can't defend yourself? Certainly not me, but I do say that the level of force you use to defend yourself must be lawful. I took a couple of butt kickings (one resulting in broken nose) and was engaged in multiple physical altercations during my police career and I never shot anyone and I have no long-lasting effects other than a slightly crooked nose. I defended myself with my hands, feet, OC spray, a baton, and a flashlight. I worked with cops who had a Taser or even pistol-whipped a suspect during an altercation. I was in one lengthy fight where I grabbed a guy's hair and bashed his head on the sidewalk. I even had an encounter with a guy brandishing a sword and due to the unique circumstances I did not need to shoot him; OC spray and hands-on tactics were sufficient in disarming and arresting the guy. You fight until you think the fight is more than you can handle, then you try to disengage if possible. If you can't retreat and you believe the beating will continue, then you might be justified in using deadly force. I'm far from being a tough-guy, but I do understand the law and the ramifications for unjustified use of deadly force. I'd like to think you are visualizing a very serious physical attack here, but based on your comments it sounds like you think you have a defense if you shoot someone for even a minor altercation. The fact of the matter is that the law is the law and just because you don't like it doesn't mean that you aren't obligated to face sanctions if you violate it. Again, it's your choice, but if deadly force isn't justified, don't be surprised if you end up a guest of the state for the remainder of your natural life.1 point

I keep 100 rounds of critical defense in 9mm,40 s&w and 45acp for self defense purposes. I have heard that hollow point ammo is not really necessary in 45acp for self defense. This line of thinking is the round itself is large enough to do the job. Is this line of thinking correct or not?1 point

So, these are just words with no meaning? "39-11-622. Justification for use of force -- Exceptions -- Immunity from civil liability. (a) (1) A person who uses force as permitted in §§ 39-11-611 -- 39-11-614 or § 29-34-201, is justified in using such force and is immune from civil liability for the use of such force, unless: (A) The person against whom force was used is a law enforcement officer, as defined in § 39-11-106 who: (i) Was acting in the performance of the officer's official duties; and (ii) Identified the officer in accordance with any applicable law; or (iii) The person using force knew or reasonably should have known that the person was a law enforcement officer; or ( B ) The force used by the person resulted in property damage to or the death or injury of an innocent bystander or other person against whom the force used was not justified. I gotta agree with NRA about the CMP. IMHO it's not what it's cracked up to be. Yes, the folks that haunt the forums are helpful but the CMP is just another money grabbing Ho in Govt clothing. Go ahead ask me why? Anyone old enough to remember the DCM? It was actually set up to teach civilians who could legally own firearms how to shoot and allowed them to purchase military surplus firearms. Kinda like keeping our folks knowledgeable about shooting skills. Militia? Let's not go there right now because the real issue is all they do now is take in surplus rifles, run a safety check on them and then pretty much sell them to the highest bidder. Somehow and IMHO that was never the reason for the DCM. I remember you could go to a DCM shoot, qualify with a Garand and walk away with one new in the box for $200. Now it's, "if you want a Carbine then go to the auction and bid on one". So, is it a civilian marksmanship program or just another way to make a bunch of money, that goes where, to do what? If the rifles were meant for U.S. folks then they should ALL be put up for sale on a first come, first served basis with a set price and no auctions along with 1 per customer. When now more sales are forth coming then open rifles back up to allow one more per customer. So yes, I agree with NRA. Lp1 point

The answer to your question is simple: injuries heal and death is permanent. Our legal system generally believes that every human being has a fundamental right to exist and we don't take people's lives except in the most serious of circumstances. Seriously, how many people do you know who have gotten a serious butt kicking who didn't survive and were no worse for wear? Add in the reality that most physical altercations are predicated upon an exchange of verbal jabs and if we allowed the use of deadly force in the face of a simple physical assault, people would have a ready-made defense should they want to kill someone. All they would have to do is start a verbal altercation, wait for the person to attack, and then kill them claiming self-defense. Of course, the totality of the circumstances is important. Take RichardR above for instance. A person with numerous ailments that limits their ability to effectively defend themselves is quite different than a young and fit individual. A small person going up against a larger and more physically fit person is another situation. What you must do is be able to justify that you reasonably believed there was an imminent risk of death or serious bodily injury as outlined in the TCA, and that deadly force was your last option. Even the castle doctrine is based on the idea that an intruder poses an immediate risk of death or serious injury to you and your family, not that you are protecting your residence or property. Also, you have to live with yourself and your decision, so do you really want to live with the idea that you killed some loudmouth to keep from getting a bloody nose? I certainly don't, especially on top of the risk of being criminally and civilly liable for my actions if they weren't absolutely and clearly justified. Those who say "better to be judged by 12" have never been the subject of civil and criminal action for an unjustified shooting. I'd bet a dollar to a donut that Zimmerman wishes he'd kept his butt in his truck, even if the shooting is ultimately ruled as justified.1 point

I unfortunately suffer from a number of ailments, osteoarthritis, degenerative disk disease, along with multiple ruptured, herniated & buldged disks. I can usually manage walking short distances without assistance, but I keep a cane handy & even a wheel chair at the house because well some days are worse than others. I spent 9 months trapped in my wheel chair & spent several years of agony going through physical therapy to get to where I am now. The greatest fear I usually have is slipping and falling down, there is no way on God's green earth that I am going to allow myself to "take a beating" ..... I will do everything that I can to walk away, but the moment I think that walking away is no-longer an option my pistol is coming out. Once it comes out of it's holster the person or person(s) who forced that action had better do exactly as I tell them (keep their hands where I can see them & to stay exactly where they are until the police arrive). I am not a hardass, nor do I ever allow myself to get into shouting matches which could be considered "escallation of an altercation" if God forbid I am ever involved in a self-defense shooting it will have happened because I could not escape & they would not comply with my commands.1 point

I agree with the advice above regarding using Paypal and going off the seller's rating and reviewing any negative feedback they may have. Does this appear to be an individual or a true re-seller? Is your main concern just getting the product period or the product not being in the condition represented? I'm guessing the later since sellers usually can't get by with stiffing people otherwise they get shut down by Ebay. If it's a large re-seller then their knowledge of the product will be limited since they are just moving the product through. They most likely won't be aware of small issues that might be present on a higher end bicycle. There can be derailleur issues or a cracked frame that aren't obvious. In that case the seller may not necessarily be trying to rip you off, they just didn't know about the problem. If their return policy looks solid, then that might make me feel better. It's just me but it would have to be a very sweet deal before I would buy a bicycle that wasn't close enough to see in person. Just not worth the risk IMO so I prefer Craigslist or a LBS bulletin board.1 point

Maybe I misinterpreted the situation but ... that seemed to escalate quickly. Lets all put the guns down, step away from the situation, and realize that what happened here didn't really require anyone getting there feelings hurt. And lets stop the name calling and hypersensitivity, "it seems like the responsible thing to do."1 point

Grab a Thompson Center Dimension. They have a similar setup. Then build a chassis for it. Rifles are ~$600 and barrels are ~$200. Shop costs to build what you are looking at is going to be more than that.1 point
